00 - Revocable (R) Permit Revocation Process

Below is the general information about revocation of R-Permits.    In many cases, a specific type of R-Permit requires additional tasks for revocation.  Please see the specific Technical Procedures document under the R-Permit section of this manual for additional requirements.

TIER 1 AND TIER 2 REVOCABLE PERMITS

1. R-Permits originally issued by the District Engineer (Tier 1 and Tier 2) can be revoked if it is determined that the encroachments are in violation of the permit conditions.
2. The District Engineer shall inform the Bureau of Street Services to issue a “Notice to Comply” to the Permittee.
3. If the Permittee disagrees with the District Engineer’s determination, the Permittee may appeal this determination, in writing, to the Board.
4. If a controversy exists, a board report shall be prepared detailing the reason for revoking the permit
5. The District Engineer shall notify all parties involved of the date, time and location of the hearing.
6. In either case the District Engineer shall collect all relevant supporting documentation, including the file, photos and any citations issued.  Citations from Street Use Inspectors may be obtained by contacting the Bureau of Street Services, Street Use Inspection Division.

TIER 3 REVOCABLE PERMITS

1. If the District Engineer determines that a Tier 3 R-Permit should be revoked, a board report shall be prepared detailing the reason for revoking the permit.
2. The District Engineer shall notify all interested parties involved of the date, time and location of the hearing.

COMPLAINT RECEIVED IN OPPOSITION TO AN R-PERMIT

1. All complaints must be submitted, in writing, to the District Engineer detailing reasons for revoking the permit.
2. If it is determined that the encroachments are in violation of the permit conditions, the District Engineer shall inform the Bureau of Street Services to issue a “Notice to Comply” to the Permittee.
3. If the Permittee disagrees with the District Engineer’s determination, the Permittee may appeal this determination, in writing, to the Board.
4. If the District Engineer has determined that the Permittee has not violated the R-Permit conditions, the complainant may appeal this determination, in writing to the Board.
5. If the Board deems it necessary, the District Engineer shall prepare a Board Report detailing the District Engineer’s recommendation, including all relevant supporting documentation.
6. If the Board determines that a hearing is required, the District Engineer shall notify all individuals involved of the date, time and location of the hearing.  If a hearing is not required, the District Engineer shall inform all of the individuals involved of the determination of the Board. If R-Permit issued by District Office, the District Engineer has authority to revoke the permit.
