GENERAL CONDITIONS OR REQUIREMENTS


By accepting a "B" Permit, the Permit Applicant for which the permit was obtained agrees to follow all rules, regulations, special conditions, and code requirements and to verify their employees, contractors, and subcontractors comply with all rules, regulations, permit conditions, and code requirements.

"B" Permit plans must be signed and submitted by California Registered Civil Engineers, ultimately making the Private Engineer liable for the end product.

PERMITTEE OBLIGATIONS & REQUIREMENTS


Checklist IconThe Applicant for a "B" Permit must be the owner of the affected property. There are exceptions, such as when another governmental agency has a contract requiring a permit, in which case the Contractor may be the Applicant. If the property is owned by a corporation, the application must be signed by an officer(s) of the corporation and have the corporate seal affixed.

In almost all cases the conditions or requirements that necessitate the need for a "B" Permit come from Planning Case or Zoning Actions. These conditions were usually jointly agreed upon by BOE, DOT, and the Planning Department well before the submittal of plans to be checked. However, in some instances the physical conditions of the improvement location make it impossible, impractical or extremely costly to design to the required conditions. In these cases, the conditions may need to be modified (modifications to any conditions must be approved by City Planning) before starting any plan checking to save the applicant unnecessary checking costs. BOE plan checkers should determine exactly what is required for the Conditions of Approval and should field check where the improvements are to be constructed for unknown problems.

Applicants are responsible for fulfilling conditions per LAMC 62.105 and paying fees in person per LAMC 62.110 and LAMC 62.111.

"B" Permit Public Notification for an Unimproved Public Right-of-Way in a Hillside Area

Per LAMC 62.105 - Streets, Sidewalks and Other Improvements - Permit Required an applicant for a Class "B" Permit for a street improvement on an unimproved public right-of-way in a Hillside Area, as defined in LAMC 12.03, is required to: 

  1. Mail (registered or certified) a notification of public roadway construction, using a form approved by the Bureau of Engineering, to all owners and occupants of properties within a 500-foot radius of the proposed street improvement, prior to the submission of the application for a Class "B" permit;
  2. Provide proof of mailing of the required notification to the Bureau of Engineering as part of the application for a Class "B" permit; and
  3. Mail (registered or certified) a second notification of public roadway construction, using a form approved by the Bureau of Engineering, to all owners and occupants of properties within a 500-foot radius of the proposed street improvement upon approval of the "B" Permit plans by the Bureau of Engineering, and provide proof of mailing of the required notification to the Bureau of Engineering prior to the commencement of any construction activity under the Class "B" permit.

Safety

In general, safety requirements for "B" Permits shall be follow the Safety Guidelines for Development Services permits. Specific safety requirements will be listed as conditions of "B" Permit approval and must be maintained by the Permittee.
